BEING RULED IN A FREE STATE

The ongoing year has been saddening and have arisen this fear of living in a country I always appreciated for the fundamental rights we as a citizens have been given under the Constitution  of this so called great country. I have always been one of the foremost promoter of India knowing that what we have as a citizen of this nation is ahead of any other country in the world. The freedom of speech of all has been the most important right I have always been proud of and relished so far. Its this right that has so far made me express myself and not feel strangled in a free nation. Being an active member of the system as a lawyer I have always believed our laws are made in such a way that doesn’t just makes us free people but also gives us the sense and feel of freedom and not feel feared and scared.

When we chose non violence it was the resilience and freedom of speech that brought us the independence. The fundamental right of freedom of speech is not something they inculcated today in our constitution but it has been from the very first day. Back in the 50’s also it was thought that it is the freedom of speech which will make us a nation of above others and make us strong to accept criticism and evolve from it.

I got a message today from Nabeel (@softykid) saying that he was scared he might be also a victim one day as he is on the more.  This got me to introspect the past year and its shocking to rewind back to incidents when a businessman is arrested for a tweet on a politician’s son or a man being arrested for taking a picture of a minister and young girls being arrested for expressing their views. Where are we heading to??? Is this acceptable?

Most of these recent incidents had been contentious for the reason of an amendment to the IT Act wherein Section 66A was inserted. On a plain reading of Section 66A it sounds strangely drafted. Things have been left for the interpretation of the complainant and weirdly our enforcement agencies are not competent enough to interpret it in consonance with Article 19 (1)(a) of the Constitution. So if things are taken on the wordings of the Section 66A which says a mail message sent for the purpose of causing annoyance or inconvenience to a person can lead to an imprisonment of upto 3 years with fine, how is the annoyance and inconvenience to be measured? If someone calls me a liar as I am a lawyer, it can be annoying for me, but then does my annoyance means a person be sent behind bars and ripped off his liberty and freedom? The interpretation of a Section has to be in consonance with the Constitution and nowhere violative of the basic rights and freedom provided to us under the Constitution.

I believe if the interpretation of a Section cant be done accurately and in the spirit, it is for our legislature to bring clarity to it. For me Section 66A is beyond the spirit of the Constitution and it will be a fit case for the courts to struck it down. I was reading the letter written by Justice Katju to the CM of Maharashtra and I totally agree with him that we are living in an arbitrary State where the entire system, be it the government or the opponent are hand in hand. I, at the end feel helpless that we are reaching a state of anarchy and justified violence and power. As always I still believe that we are the biggest fools living in this paradise who actually give power to these people who try to rule us in a free country. This way the time isn’t far when I will feel weak to call myself an Indian.

FIGHT AGAINST CORRUPTION OR FOR JAN LOKPAL BILL !!

The Second Struggle for Freedom, the uprising as its being called is truly remarkable. The way it has managed to get all our attention would bring shame to the best marketing gurus. I had followed the Anna Movement very closely last time. Was actively a part of it, protested with Anna at Jantar Mantar, spoke in his support, till I read draft of the so called ‘Jan Lokpal Bill’ (JLB). I had serious reservation in supporting the JLB and also the way it is being tried to be imposed. Yes imposed because it is detrimental to the future of our nation.

Most people supporting and agitating out on the streets demanding the enactment of the JLB are unaware what it is in black and white. The government has proposed a Lokpal Bill which is being said to be worthless. I agree to a lot of extent. But if the Government’s Bill is not worthy it doesnt make the JLB worthy, it too has some serious flaws. The JLB seeks to make an investigating agency which will have a supreme power to prosecute anyone on a complaint made by any person. The JLB seeks to question any decision taken by the Government. The JLB seeks to prosecute the Judiciary on any complaint. I think this is nothing but creation of a body supreme to rule the country. A body which if it wants can bring the country to a stop at its whims. What if this body goes corrupt? Its being said it cant go corrupt. This make me laugh thinking that the corruption at the end is a creation of we the people who are fighting against it today. Corruption is a wrong we have been committing just for own convenience. If we can elect corrupt people to the parliament then what will be the guarantee that the people elected as lokpals wont be corrupt?

The Judiciary which is being lauded lately for its role in bringing the Government and corruption in the dock, will unable to function with the JLB in its entirety in force. Think of a scenario that a Judge passes a judgment against some person and that person makes a complaint to the Lokpal that the decision of the Judge has been biased because of his being corrupt or because he has been influenced by the opposite party. The Lokpal starts investigating the complaint and even though the Judge has been honest and even if he is subsequently exonerated, he will be in the docks and go through a mental harassment. It will ultimately take away his boldness and affect his performance. The same would apply to the PM. I am not saying that a corrupt decision should not be checked, but then it should not take away the independence these authority have been entrusted with under the Constitution. It should not make it possible for them to be put on ransom.

Corruption is an issue we all wish had never been. The economic development the PM was talking of the other day in his statement would had been manifolds, we might have even probably been ahead of China had the corruption not been the inherent feature of your life. We all are sick of this and its even the wish of the corrupt that the corruption should be killed, after all even they face corruption sometime in their life. But the JLB is not going to kill corruption. It can not erradicate the corrupt, cause we all are an equal participant in corruption. We need to understand that until unless we change ourselves nothing can be corrected. If we don’t stop bribing, then even the Lokpal will have no effect. If we don’t elect with due application of our mind then we will always be ruled by the corrupt.

The bill drafted by the Government is definitely not strong, but the JLB created by a bunch of people who claim to be representatives of the civil society of which we all are a part of, is also not practical. If I had the option to select my representative as a member of the civil society I would surely not choose most of these people who are the self elected member of the civil society. We need a Lokpal bill but neither of the versions in its actual form, the law laid down should be practical and not something which can be a road block in the future.

I do support a movement against corruption, I do applaud the people agitating against corruption, I do want corruption to be history. But I dont support a movement to bring a bill. We have to understand that the issue is corruption and not just getting a law. As I had written in my earlier post comparing the movement to the Jasmin revolution, the movement should not be focused to the JLB but should be focused towards the bigger issue of eradicating corruption. We need to rise above corruption and lead to a path to a society which does not put us in stress. We need to act as a literate society and apply our own mind, surprisingly most of those agitating have no knowledge about the JLB. We should not flow with emotions and be puppets to some people. The movement is not about one person, it is about the cause. I would really request all those supporting the JLB to understand the Bill and to foresee the implications. Its not that we dont have laws to check corruption. Our existing laws are also stringent enough to curb corruption. The Prevention of Corruption Act is one of the most stringent laws we have, it is even applied strictly, but then there are certain provisions which makes its applicability difficult. What we lack is the proper application of the existing laws, the proper functioning of the entire system. What we need is laws towards the accountability of the Government officials and the Judiciary.

So let’s support the campaign against corruption, not a campaign for JLB. Let the things be done under the constitutional framework. Lets understand that just a bill is not going to curb corruption but it is us who has to change to bring corruption to a halt. So next time when you are caught for a traffic violation then don’t try to escape from the shorter route, be bold enough to face the consequences of your mistake.

UNCHANGE THE CHANGE !!

Change, one word which is connected with us from the moment we open our eyes in this weird world. From our inception all that we are asked for is to change, all that people expect from us is to change. We too are a part of the gentry and we too keep trying our best to change everything and everyone around us to suit our own comfort and convenience. But what we always forget is that the same force is working on us, even we are being changed in this changing process. We all believe that change is good, after all this is what fuels the process of evolution. But somehow we don’t realise that this change is mostly not for good.

Its said love should be unconditional, and true love always exist. I think its true and it does exist as its true only when we be what we are and let our partner be what they are. But most of the times we end up changing ourself or our partner and then fall off love. Fall off because the person we loved doesnt remain the same, change takes its toll and so it’s not possible to love this new person who emerges after the changing process.
If we start being ourself and we stop expecting the unexpected from anything and anyone things would be less wrong in life. We all are right in our own ways, in our own perception and understandings. So we should try to understand what we think to be wrong is right for the other, give it a hearing before coming to a conclusion, maybe what you believe to be right might actually be wrong. It is the bit of innocence in us that still keeps some love and smile alive in this rigid world. I always thought that a child is life in its purest form, unfazed by anything good or bad, for the child everything is good and nothing is bad, till he/she learns it or is taught about it.

Change is needed and we can’t live without changing, after all we move to a new day with every step of ours. But we always try to change others and let others change us, I believe that if we try to change ourself and let others change themselves then we surely would love this change as it would be for the good, after all nobody knows you better than you.

‘Knowing or believing’

During one of my travels I had met a bunch of people, we started talking and then we decided to play a game introduced by this guy as the travellers game, a question was to be asked which would have 2 options and every one had to choose one option and reason his choice. We were 2 guys and 3 girls, none of us knew each other from before and interestingly we all were from different countries, different in our nature and culture. Thought the game to be a bit childish, but when we started playing it was insane how our intellect was tingled and how we were different from each other in our thoughts and perspective.

The first question shot was ‘stream or ocean’. 3 people chose ocean, describing it as the symbol of greatness and power, the size and magnitude, the unending and the Ocean’s take it all nature. It was interesting to see the way they compared ocean to life. The other guy chose stream as he felt that the stream had the ability to change and become a river while the ocean was too perfect. I too chose stream and reasoned that it was similar to our lives as it goes through ups and down, straight and turns, and it made its own path. What struck me was that the 3 girls chose ocean while we 2 guys chose stream. It was wonderful how we all were conceptualizing extempore ideas about the same things relating them to our own life.

There were questions like ‘melody or beat’, ‘love or lust’, if suicide was an act of ‘bravery or cowardice’, but the one which particularly struck me was a question by this girl ‘knowing or believing’. Every one chose knowing except Me. All of them had their reasons, kind of similar to each other. For them knowing was what made them believe. Knowing was the existent and factual part of life which made us do things correct and without the knowing belief was nonexistent. One of them actually chose both the options as for her both were interconnected and they together made us move in life.

It was my turn and I was on a fix, as I thought what everyone said did make sense. Afterall seeing was believing and the fact was always supreme. I chose Believing. If I didn’t believe before knowing then all my dreams would had been trash, the fantasies which were factually nonexistent were existing because I believed in them. For me it was the belief which gave me the zeal to know things. Its believing in things which gave me the kick and excitement, as without it the world would be all black and white as it is my belief which adds the colour to this factual world.

It was a wonderful experience to see how we all are unique in our own ways and how our thoughts made us different from eachother.

SELF PLEASURE …

I love myself more than anyone else, I think I am always right, I feel I don’t commit mistakes, I am above all. That’s my self obsession, ME ME ME. Was asked if it’s same as self centered? Hmmm after thinking a lot I answered that it was not being self centered. Why? Well even though I was supreme, I somehow cared for others more than me. I know I am talking about a flaw in me, something which I never spoke openly before, something which is irritatingly wrong. Was thinking once and a question came in my mind, isn’t self obsession like enjoying Masturbation more than Sex. Whoa couldn’t really give an answer to myself. I always tried to prove the wrong right just because I couldn’t be wrong. I would want things my way for the reason that my way was the right way even if it was wrong. I then realised that somehow I have got good in convincing people over the time and always succeeded in convincing the one who was right to do my wrong.

I never really met the one who would not get convinced by me, who would stand by his or her obsession. I was getting good in being right always, but then I was getting worse within as I was losing myself in this ordeal. But the ME in ME was so strong that it was difficult to be wrong. But I still had some good in me left somewhere, the little Mr. Good in me, who made me realise the mistakes I commit due to my obsession, and who made me accept my errors. So I would always accept it if I was wrong and would somehow sometime try to realise my mistakes, punish myself, though I would be a little extra liberal in the punishments.

So why am I writing about this, trying to bare the hidden faults of me, making myself vulnerable and porous. Because I realised that all this was making me the Villain in the movie of my life. That small hero in me wanted to execute me, to be brutal with me. Though the tussle between the good and bad in me gave me a kind of sadistic pleasure, as the tryst between the good and bad was often, after all good is always attracted to the bad, I wanted it to end. Why can’t I be good and good, hmm I think we need some badness in us to balance and realise the worth of the good, so there has to be some bad in us, but only some, the good should always be more than the bad. So here I am, trying to change myself, to make my good stronger and be able to make the good and bad in me friends. I have been changing now for a while, I accept more NO’s than YES, I don’t turn my back when I am rejected, I don’t make a sad face when my shot doesn’t hit the target. But why am I writing? As I thought that I can’t succeed alone, after all you all have been my partner in crime, so I need you to get me better. I want my I to change to You. So stop getting conned by me and start telling me my wrongs. Ah yes don’t do it in one go, would kill me, be a little generous on me, after all I am not that bad 🙂 As promised I am barking myself out. WOOF WOOF !!

REALITY VIRTUAL !!

The world in our generation has moved from reality to virtuality, virtual is now more real than the real. The virtual world is more powerful than the real. Though we are alive in the real world we are living a virtual life. The first thing I do today when I wake up is to check my emails, my social networking space, twitter and blog. Everything else comes next. We cry, we smile, we get angry and fight in real for something that happens virtually. Today we want our online profiles to look more beautiful than our homes, afterall we technically live there than in reality. A friend of mine met me a few months back with an idea to make virtual something we do in real. He wanted to provide a platform for the netizens (yes being a lawyer we extensively studied about citizenship, but netizenship is a concept yet to be legally ratified) to protest. I told him that this is already happening. We protest by showing our displeasure on our blogs, social networking sites and the likes of twitter. We all do it, even though it is mostly not heard. He then asked me if I am angry over some issue and would want to break glasses or maybe set a bus on fire, can we do it virtually. Well honestly I wouldnt do it even in real, So his idea was to let us protest and show our anger by doing things we are not able to do even in reality. A place where protest petitions be signed, show our displeasure by quietly lighting a candle or make noise by breaking glasses. And the idea was to get heard by those who needed to change, those who had committed the wrong. I thought if this was practical, if it made sense. It somehow did, but I told him that it might not be totally viable. The same guy called me 2 days back and asked me to check http://www.indiaprotest.org, i checked the website and was amazed that he had brought his thoughts and ideas into life. The website was interactive and I could register my protest in ways I could not do in reality. Though it was a little far fetched but it gave that satisfaction of releasing the anger. Great innovative website, it surely can bring a change to the way we protest and can make a dent on those who think themselves to be immortals. The way we are moving out of reality towards the virtuality, its not too far when we would all have the split personality disorder. We are two different people online and offline, trying not to mix the two. The mixing of the two would definitely bring around a fatal change. It would get difficult to live both and eventually choose one. Thats why I think a balance of both is needed. The moment one takes over the other, the disastrous would begin. So live virtually without disturbing the reality, coz virtual is all because of the real. Signing out..Woof Woof !!!
